Terms & Conditions

The terms that govern your use of 360 Adventures’ tours, experiences, and booking services.

360 Adventures LLC (“360 Adventures,” “we,” “us,” or “our”) provides guided tours, outdoor experiences, and booking services through our website and other platforms (collectively, the “Services”). By using our Services, you agree to these Terms & Conditions (“Terms”) and our Privacy Policy.

1. Introduction

If you do not agree to these Terms, you may not use our Services.

We may update these Terms at any time. Changes take effect when posted. Your continued use of the Services means you accept the updated Terms.

2. Who Can Use Our Services

By using our Services, you confirm that:

  • You are at least 18 years old, or
  • You are acting as an authorized representative of an organization and have the authority to bind that organization.

3. Accounts

Some Services require an account. You agree to:

  • Provide accurate and current information
  • Keep your login credentials secure
  • Notify us immediately if you suspect unauthorized access

You are responsible for all activity under your account.

4. Booking, Payments & Cancellation Policies

4.1 Payments

Some tours require full payment at the time of booking. Prices may change at any time before purchase.

4.2 Cancellation Policies Vary

Different tours have different cancellation windows. Your specific cancellation terms are:

  • Shown on the tour page at the time of booking
  • Included in your confirmation email

If these Terms conflict with the cancellation terms in your confirmation email, the confirmation email controls.

4.3 Refunds

Refund eligibility depends on the cancellation policy for your specific tour. Fees paid before cancellation are non–refundable unless stated otherwise in your confirmation.

5. 360 Adventures as Operator vs. Reseller

5.1 When We Operate the Tour

For tours operated directly by 360 Adventures:

  • We manage guides, safety protocols, and equipment
  • You may be required to sign a liability waiver before participating

5.2 When We Are a Reseller

Some tours are operated by independent third–party outfitters. In these cases:

  • 360 Adventures acts solely as a booking agent
  • The third–party operator is responsible for guiding, safety, equipment, transportation, and execution of the tour
  • You may be required to sign additional waivers
  • You must follow the operator’s rules and instructions

360 Adventures is not responsible for the acts, omissions, or negligence of third–party operators.

6. Assumption of Risk

Outdoor adventure activities involve inherent risks, including but not limited to:

  • Uneven or slippery terrain
  • Wildlife encounters
  • Weather changes
  • Physical exertion
  • Heat, dehydration, or altitude effects
  • Equipment failure
  • Transportation risks

By booking a tour, you acknowledge these risks and agree to participate voluntarily.

7. Participant Responsibilities

You agree to:

  • Follow all instructions from guides and operators
  • Disclose any medical conditions that may affect participation
  • Bring appropriate clothing, footwear, water, and gear as instructed
  • Not participate if under the influence of drugs or alcohol

Guides and operators may remove any participant who poses a safety risk or refuses to follow instructions. No refunds are provided in these cases.

8. Weather, Conditions & Operational Changes

Tours may be modified, delayed, or canceled due to:

  • Weather
  • Trail or road closures
  • Safety concerns
  • Equipment issues
  • Conditions beyond our control

When this occurs, the operator’s policies determine available remedies (refunds, rescheduling, credits, etc.).

360 Adventures is not responsible for additional costs such as travel, lodging, or personal expenses.

9. Acceptable Use of Our Services

You agree not to:

  • Engage in illegal, harmful, or disruptive activities
  • Upload or transmit viruses or malicious code
  • Attempt to access or modify systems without authorization
  • Impersonate another person or entity
  • Post unlawful, defamatory, obscene, or infringing content
  • Use our Services to advertise or sell third–party products

We may remove content or suspend accounts at our discretion.

10. Intellectual Property

All text, images, logos, graphics, and other content on our website are owned by 360 Adventures or our partners. You may not copy, distribute, or modify our content without permission.

11. Disclaimers

Our Services are provided “as is” and “as available.” We do not guarantee:

  • Error–free operation
  • Uninterrupted service
  • Specific outcomes or results

To the fullest extent permitted by law, we disclaim all warranties, express or implied.

12. Limitation of Liability

To the fullest extent permitted by law:

  • 360 Adventures is not liable for indirect, incidental, special, or consequential damages
  • Our total liability for any claim will not exceed $100 or the minimum amount required by law

You agree that your sole remedy for dissatisfaction with our Services is to stop using them.

13. Dispute Resolution

Before filing a claim, you agree to attempt to resolve the issue with us informally. Claims must be brought individually, not as part of a class action.

14. Governing Law

These Terms are governed by the laws of the State of Arizona. Any disputes will be handled in the courts of Maricopa County, Arizona.

15. Severability

If any part of these Terms is found invalid, the remaining sections remain in effect.
